Trudeau’s New Cabinet
Canada’s Prime Minister Justin Trudeau revealed his new cabinet last week which included the re-selection of ministers. Sean Fraser is the country’s new Minister of Immigration, Refugees and Citizenship (IRCC). Fraser is a 37-year-old former lawyer from Nova Scotia that was first elected as a Member of Parliament in 2015. He was re-elected in 2019 and 2021. He replaces Marco Mendicino, who now becomes Canada’s public safety minister. Fraser represents the riding of “Central Nova” which covers a part of Halifax. Prior to entering politics, he practiced commercial litigation and international dispute resolution. He holds a law degree from Dalhousie University, a Master’s degree in Public International Law from Leiden University in the Netherlands, and a Bachelor of Science from St. Francis Xavier University.
Promises and Mandate Letters
With cabinet set, the Liberals will continue the process of governing Canada and focus on leading the country out of the coronavirus pandemic. Parliament is set to reconvene on November 22. The cabinet is the body of ministerial advisors that sets the federal government’s policies and priorities. Each minister is given a mandate letter by the Prime Minister. The mandate letter outlines the policies and priorities that the Prime Minister would like each minister to pursue during the government’s time in power. In the 2021 election campaign, the Liberals made several immigration promises. For instance, they promised to end citizenship fees. They also want to reduce application processing times and make reforms to Express Entry such as offering more immigration pathways to temporary foreign workers and international students.His Immigration Agenda
Broadly speaking, stakeholders should expect a continuity of the Liberal party’s ambitious immigration agenda that they have been pursuing since 2015. That being said, the Liberals will have major immigration issues that they will need to tackle during their new mandate. These include identifying how they will reduce application backlogs that have grown during the pandemic, potentially reforming Express Entry and the Parents and Grandparents Program, launching the Municipal Nominee Program, and waiving citizenship fees.Despite having a lot of immigration priorities on their plate, it is relatively safe to say that the coming years will be less challenging for the federal government to manage than the previous and unprecedented 20-month pandemic period.
Legislative Changes by the Ontario Labor Minister
Ontario’s minister of labour, who also oversees immigration, is calling for legislative changes to make the province a more attractive place to work. Monte McNaughton introduced the “Working for Workers Act” on October 25. If it gets passed, it could mean big changes for Ontario workers. The act includes the proposed changes that were announced last week for immigrants who are trying to work in regulated occupations in Ontario.In short, the Ontario government wants to see the requirements eased on newcomers getting licensed in non-health-related occupations. Namely, they want to remove the requirement for regulatory bodies to require Canadian work experience, eliminate the need to do a language test for the purpose of licensing, and speed up the licensing process, especially in cases of emergency.Non-Compete Agreement vs. Right-to-Disconnect Policies
McNaughton cited labour shortages in skilled trades occupations that will only increase as more workers retire. He also referred to a recent study that suggested Ontario would see an additional $12 to $20 billion added to its economy if the skills gap between immigrants and Canadian-born workers was addressed. If passed, Ontario would be the first province in Canada to eliminate the requirement for Canadian work experience in regulated occupations. It would also be the first to introduce “right-to-disconnect” policies, and to ban non-compete agreements.Employers with 25 or more workers would have to implement a policy that would allow employees to disconnect from their jobs at the end of the work day.
More Immigration Powers to Ontario
The new legislation would also restrict employers from implementing non-compete agreements, where workers have to sign a contract saying that, for a certain amount of time, they will not work for a competitor after they leave their company.Beyond the amendments to laws governing regulatory bodies, the immigration minister would also like the federal government to give more immigration powers to Ontario. For 2021, the federal government has allowed Ontario to welcome 9,000 newcomers through its Provincial Nominee Program (PNP). McNaughton would like to see that doubled due to the ongoing labour shortages that persist despite Ontario being the most popular province for new immigrants.Quebec Sets New Admissions Target
Quebec could admit up to 52,500 new permanent residents in 2022, the province said in its new immigration plan released October 28. Most of new admissions to Quebec in 2022 will come through the province’s economic immigration programs, including the Quebec Skilled Worker Program (QSWP) and the Québec experience program (PEQ).The plan stays the course on the targets established during the public consultation held in the summer of 2019 as part of Quebec Immigration Planning for the 2020-2022 period. It calls for the admission of 49,500 to 52,500 immigrants in 2022 across all categories, as well as an additional 18,000 admissions to reach the admission levels that were not met by the federal government in 2020 due to the COVID-19 pandemic. This means that more than 70,000 newcomers could be admitted to the province of Quebec in 2022. With a maximum target of 33,900, the economic category represents the largest proportion of newcomers. In this category, the province expects to welcome up to 28,800 skilled workers and up to 4,300 business immigrants, which would include investors, entrepreneurs, and the self-employed. 
Quebec Immigration Levels Plan
The remaining 18,600 new permanent residents are expected to arrive through family reunification, refugees, and other immigration programs. The immigration levels plan is presented each year by the Quebec Immigration Department. It indicates the number of new permanent residents the province intends to admit in the coming year, as well as the categories in which it will admit them. This increase is in line with the promise made by the province’s current governing party, the Coalition Avenir Québec (CAQ), to gradually increase the number of newcomers after reducing admission targets back in 2019.In addition to increasing immigration targets, other important new measures have recently been taken by the Quebec government to facilitate the arrival of foreign workers in the province.
